The Missouri Narcotic Drug Act defines the act of delivering as

The actual, constructive, or attempted transfer from one person to another of drug paraphernalia...whether or not there is an agency relationship, and includes a sale.

This definition is further refined under the Missouri Controlled Substances Act to include any act that results in the distribution, delivery or sale of drug paraphernalia; or, the possession by someone with the intent to distribute, deliver or sell drug paraphernalia knowing that its intended use is for the manufacturing, processing, testing, analyzing or using of controlled substances.

THE POSSIBLE PENALTIES FOR THE CHARGE OF UNLAWFUL DELIVERY OF DRUG PARAPHERNALIA IN MISSOURI ARE:

  1. A class A misdemeanor criminal record.

  2. A jail sentence of up to 1 year.

  3. A fine of up to $2,000.

  4. A combination of both a jail sentence and a fine.

  5. Probation for not less than 6 months and up to 2 years, either Supervised or Unsupervised.
