Distribution of Controlled Substance in Violation of Registration Requirements

REGISTRATION REQUIREMENTS

A person who is required by the Missouri Narcotic Drug Act to register with the Missouri Department of Health and Senior Services in order to distribute a controlled substance, and who knowingly distributes a controlled substance in an unauthorized manner may be charged with a class A misdemeanor.

Additionally, if a registrant fails to maintain proper records in accordance with federal law and regulations established by the Missouri Department of Health and Senior Services may also be charged with a class A misdemeanor. Sloppy paperwork can lead to charges. It is important for registered distributors to establish and put into practice a policy for maintaining a clear record of transactions, as well as inventory.

  1. A class A misdemeanor criminal record if you knowingly refuse or fail to make, keep or furnish any record, notification, order form, statement, invoice, or information required under Missouri's Narcotic Drug Act.

  2. A jail sentence of up to 1 year.

  3. A fine of up to $2,000.

  4. A combination of both a jail sentence and a fine.

  5. Probation for up to 2 years, either Supervised or Unsupervised.

  6. Costs for probation.

  7. Court Costs.

  8. Random Drug Testing and the Costs.

  9. Community Service.

  10. Loss of professional license and/or discipline by the Mo. State Board of Reg. for the Healing Arts.
